This Privacy Notice ("Notice") applies to the ABB Group of companies, which means ABB Ltd, Switzerland and each entity in which ABB Ltd, Switzerland, directly or indirectly, has a majority holding or owns or controls the majority of voting rights. The ABB company:

  • that is providing you with services,
  • to which you are providing goods or services,
  • that is communicating with you,
  • that is hosting you,
  • where you are applying for a position,
  • -or otherwise explicitly referred to in Notice

(also referred to as "ABB" or "we") is responsible for the processing of your personal data and controls how it is used, in accordance with this Notice.

Other subsidiary companies of ABB may also receive and process your personal data, either in the capacity of controller or processor and this Notice applies equally to them.



We may collect your personal data:

  • directly from you,
  • from publicly accessible sources or which are legitimately transmitted by other third parties,
  • from third parties we cooperate with,
  • information collected by the communications systems, IT applications and website browsers.

If you do not provide us with personal data that is needed for the particular process ABB will not be able to adequately perform the purposes described above without certain personal data. Although we cannot obligate you to share your personal data with us, please note that this then may have consequences which could affect the business relationship in a negative manner.


We only share your personal data with other ABB affiliates or third parties as necessary for the purposes described in this table below. Where we share your personal data with an affiliate or third party so that it is transferred to or becomes accessible from outside the European Union (“EU”) and the European Economic Area ("EEA") or outside the country where the ABB company that controls your data is located, we always put adequate safeguards in place to protect your personal data. Examples of these safeguards are an adequacy decision of the European Commission or Standard Contractual Clauses. We have taken additional measures for the transfer of data from within to outside the EU, EEA and outside the country where the ABB company that controls your data is located to protect your personal data. Recipients or recipient category:

  • ABB affiliates and subsidiaries - See the list of ABB subsidiaries – The purpose described in Notice;
  • ABB business partners, distributors, and agents (EU/EEA and non-EU/EEA (global) – The purpose described in Notice;
  • Service providers such as IT services, marketing agencies, independent agents, payment processors, rating and assessment services, professional and advisory services including accountants, auditors, lawyers, insurers, bankers, recruiters, HR assessment providers, travel agents and other advisors or service providers working on ABB’s behalf (EU/EEA and non-EU/EEA (global) – The purpose described in Notice;
  • Our banking and financial services partners and payments networks - To help us provide our services to you. This includes banking and lending partners, banking intermediaries and international payment service providers (EU/EEA and non-EU/EEA global) – the purpose described in Notice;
  • Insolvency administrators or creditors (EU/EEA and non-EU/EEA (global) - For default and insolvency management;
  • Potential or actual acquirers of ABB businesses or assets (EU and non-EU) – For the evaluation of the business or assets in question or executing the transformation/merger of the companies of for the purposes described in Notice;
  • Recipients as required by applicable law or legal process, to law enforcement or government authorities, etc. (EU and non-EU) - Where required by applicable law or a legitimate request by government authorities, or a valid legal requirement.

Based on mandatory legislation, ABB must keep certain personal data for a minimum period of time. We only keep your personal data for as long as necessary for the purposes described in this Notice.

More details on how we store personal data you can find in the appropriate subsection.

At the same time, applicable data protection laws require that we do not keep personal data in an identifiable form for any longer than is necessary for the purpose for which the personal data is being processed. Through the setting of IT applications and policies we ensure that our keeping of your personal data is deleted or anonymized when we no longer need it.


Depending on the jurisdiction in which you are located and in which your personal data is processed, you may have the following rights:

You may request that personal data be erased when it is no longer needed, where applicable law obliges us to delete the data or the processing of it is unlawful.

The right to restrict data processing

You have the right to restrict the processing of your personal data in specific circumstances.

The right to data portability

You have the right to receive your personal data in a structured, machine-readable format for your own purposes, or to request us to share it with a third party.

The right to object to data processing

You have the right to object at any time, for reasons arising from your particular situation, to the processing of your personal data, which is based on a legitimate interest

The right to withdraw consent

Where ABB has asked for your consent to process personal data, you may withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

Please note that the rights described above are not absolute, and that your request cannot always be met entirely. For example, sometimes we cannot delete or restrict the processing of your personal data as we may have legal obligations or contractual obligations to keep certain personal data.

If you want to access your personal data, make use of any of your other rights mentioned above or if you have any questions or concerns about how ABB processes your personal data, please submit your request at www.abb.com/privacy. Should you not be satisfied with our response or believe we are processing your personal data against the law, you may also have the right to file a complaint with the Data Privacy Authority in your country of residence or work, or seek a remedy through the courts where you believe an infringement of data privacy laws may have taken place.


This Privacy Notice may be updated from time to time as a result of required developments. In case of such updates, we will undertake necessary actions to inform you about them depending on the importance of changes done. If and where required by applicable laws we will also ask for your consent to any material Privacy Notice changes describing our up-to-date practices.

If you are not satisfied with our response or believe that we are processing your personal data unlawfully, you also have the right to lodge a complaint with the competent data protection authority in your country of residence or work or to seek a remedy in the courts if you believe that a breach of data protection laws may have occurred. Further the provisions as contained in the   Protection of Personal Information Act 4 of 2013, as amended (POPI Act) shall be applicable. In the event of any discrepancies, ambiguities or contradictions, the provisions as contained din the POPI Act shall prevail.

In accordance with Article 30 of the Protection Act, we provide the following additional information on personal information for Korean data subjects in order to inform them of the procedures and standards for the processing and protection of personal information and to enable them to promptly and smoothly handle any grievances related thereto.

We collect and use personal information to the minimum extent necessary to provide our services in accordance with the protection laws.

Children

It is the Company's policy not to collect personal information from Korean data subjects under the age of 14. Therefore, if you are a Korean data subject under the age of 14, you should not provide personal information to use our services.

 

Processing and retention period of personal information

In principle, after the purpose of collecting and using personal information is achieved, the information is destroyed without delay. However, if it is necessary to preserve it in accordance with the provisions of the relevant laws and regulations, we will keep the member's information for a certain period of time as stipulated by the relevant laws and regulations as follows. In this case, we will move the personal information to a separate database (DB) or preserve it in a different storage location.

 

- Records related to contract or withdrawal of subscription: 5 years (Act on Consumer Protection in Electronic Commerce, etc.)

- Records on payment and supply of goods: 5 years (Act on Consumer Protection in Electronic Commerce, etc.)

- Records of consumer complaints or dispute handling: 3 years (Act on Consumer Protection in Electronic Commerce, etc.)

- Records on collection/processing and use of credit information: 3 years (Act on the Use and Protection of Credit Information)

- Records on display/advertising: 6 months (Act on Consumer Protection in Electronic Commerce, etc.)

- Log records of user's internet access/tracking data of user's access point: 3 months (Act on Protection of Communications Secrets)

- Other communication fact verification data: 12 months (Act on the Protection of Communications Secrets)

 

Procedures and methods for destroying personal information

In principle, the Company destroys the information without delay after the purpose of collecting and using personal information is achieved. However, if the personal information retention period agreed to by the information subject has elapsed or the purpose of processing has been achieved, but the personal information must continue to be preserved in accordance with other laws and regulations, the personal information shall be transferred to a separate DB or preserved in a different storage location.

 

 The procedure and method of destruction are as follows

(1) Destruction Procedure

The Company selects the personal information for which the reason for destruction has occurred and destroys the personal information with the approval of the Company's personal information protection officer.

 

(2) Method of destruction

Personal information stored in the form of electronic files will be deleted using technical methods that do not allow the records to be reproduced. Personal information printed on paper will be destroyed by shredding or incineration.

 

Overseas Collection of Personal Information

We collect and process personal information outside of the United States in order to provide our services.

Provision of Personal Information to Third Parties

We process personal information of Korean data subjects only within the scope specified, and provide personal information to third parties only in cases falling under Articles 17 and 18 of the Protection Act, such as consent of the data subject or special provisions in the law, and otherwise do not provide personal information of the data subject to third parties.

 

The personal information that we provide with the prior consent of the Korean data subject is as follows.

We may provide personal information without your prior consent when we cannot obtain your prior consent, including when requested by an investigative or supervisory agency in accordance with the provisions of relevant laws and regulations or the procedures and methods set forth in relevant laws and regulations, and when it is clearly recognized that it is necessary for the urgent interests of your life, body, or property or that of a third party. In this case, we will only provide the minimum amount of personal information required under the applicable law and will not provide it for any other purpose.

 

Outsourcing of Personal Information Processing

We outsource the processing of personal information as follows.

When entering into an outsourcing contract, we specify in documents such as contracts the prohibition of processing personal information other than for the purpose of performing the outsourced business, technical and administrative protection measures, restrictions on re-delegation, management and supervision of the outsourcer, and liability for damages in accordance with Article 26 of the Protection Act, and supervise the outsourcer's safe processing of personal information. In addition, we obtain our consent when the outsourcer re-delegates our personal information processing business in accordance with Article 26(6) of the Protection Act.

 

We will disclose any changes in the content of the consignment or the consignee through this Privacy Policy without delay.

 

Measures to ensure the safety of personal information

We take the following measures to ensure the safety of personal information.

(1) Administrative measures: Establishment and implementation of internal management plans, operation of a dedicated organization, and regular employee training

(2) Technical measures: management of access rights to personal information processing systems, installation of access control systems, encryption of personal information, installation and update of security programs

(3) Physical measures: Access control to computer rooms, data storage rooms, etc.

 

Installation, operation, and rejection of automatic personal information collection devices

The Company operates 'cookies' that store and retrieve user information from time to time. A cookie is a very small text file sent to the user's browser by the server used to operate the Company's website and is stored on the user's computer hard disk.

To provide targeted marketing and personalized services by implementing an automatic login function, analyzing the access frequency and visiting time of members and non-members, identifying users' tastes and interests and tracking their traces, and identifying the degree of participation in various events and the number of visits.

You have the right to choose whether to install cookies. Therefore, you can accept all cookies, confirm each time a cookie is saved, or refuse to save all cookies by setting options in your web browser.

However, if you refuse to install cookies, there may be difficulties in providing the service.

Use the "Settings" menu to set the highest level to "Block all cookies".

Information subjects and their legal representatives may request to view, correct, delete, suspend processing, withdraw consent, etc. of their personal information at any time. Changes to the Privacy Policy

With respect to Section 4 PARTIES WITH WHOM WE SHARE YOUR PERSONAL DATA, personal data relating to individuals in Switzerland will be processed by ABB affiliates and third party service providers located in Europe (mainly in Germany, Ireland, Poland and the Netherlands) as well as in the United Kingdom, India and the United States of America. In addition, personal data may be transferred to ABB subsidiaries in other countries. 

If a recipient is located in a country without adequate legal data protection, ABB contractually obliges the recipient to comply with the applicable data protection (ABB uses the revised standard contractual clauses of the European Commission, which are available here: https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj?), unless the recipient is already subject to a legally recognized set of rules to ensure data protection and ABB cannot rely on an exemption provision. In addition, ABB ensures an adequate level of protection for personal data when it is transferred outside Switzerland by applying appropriate technical and operational measures.
